A player may use Lt. Surge's Bargain if they have no cards left in their deck. In this situation, if the opponent refuses to have each player take a Prize card, the player simply doesn't draw cards from the deck.[1]
If a player uses Lt. Surge's Bargain when both they and their opponent have 1 Prize card remaining, and the opponent agrees to have each player take a Prize card, Sudden Death is triggered.[1]
Trivia
This card's effect is similar to that of Lt. Surge's Treaty, though this card is a Supporter card, and the opponent of the player who plays this card may allow the player to draw four cards instead of only one.
